The murder trial of Senzo Meyiwa resumes this morning at the Pretoria High Court. The trial was postponed on Wednesday after the existence of a second docket was brought to light by Adv. Mshololo.
The second docket allegedly implicates Kelly Khumalo and everyone else who was in the house in October 2014 when Meyiwa was killed. The revelation of this docket is expected to prove what the defense and Meyiwa family have been preaching, that the crime scene was tampered with. As well as the possibility of the bullets that were found on the crime scene on that day could have been planted.
Meyiwa’s brother has maintained that the 5 suspects we see in court are being used as a scapegoat. ‘’I feel for them because they are not involved, they were almost killed in prison for something they did not do’’ he said. He continued to say that the docket reveals that his brother was shot mistakenly during an argument with Zandi Khumalo, and that the crime scene was cleaned up by a lady known as Phiri.
The National Prosecuting Agency is also expected to give a detailed account of why they did not reveal any information about docket 375. Why did they choose the one docket over the other, what was the criteria? According to legal expert, Melusi Xulu it is uncommon that there are two dockets opened for one murder and both dockets give two different scenarios.
The National Prosecuting Agency will give clarity on the decision to prosecute the five men who are currently in the dock, Sergeant Thabo Mosia is not expected to take the witness stand, as the defense will be focusing on unpacking the 375 docket that has surfaced.
Meanwhile, Kelly Khumalo’s lawyer says her client was supposed to be the first witness in the trial as she is not only an eyewitness, but she can explain the events of the night Meyiwa was shot dead and if the five accused that are in the dock are indeed the right suspects.
